With the help of the legal bureau lawyers, the bankruptcy manager recovered in court from the city administration the amount of the debt, as well as the penalty under municipal contracts for land improvement works and major repairs. The reason for going to court was the failure of the city administration to fulfill obligations to pay for the work performed.
The company filed a lawsuit in court with the requirement to the City Administration to recover funds for payment of services under the contract, as well as the amount of penalties. The court conducted an examination of the service acceptance acts, for compliance of these amounts to resources invested. No violations revealed.
A counter-claim was filed for the recovery of a penalty for the late performance of work, as well as for failing to fulfill its obligations to remedy the work done poorly under the municipal contract. The defendant did not recognize the claim relating to the main debt and penalty collection, did not provide any calculations. The administration applied for a re-examination.
